1. Definitions

"HerbAir Pro" refers to the convection-based thermal diffusion system for botanical volatilization, including hardware devices, firmware, cloud services, and this web application, operated by HerbAir Pro (Pty) Ltd.

"Device" refers to any HerbAir Pro hardware unit registered to your account.

"Service" refers to the cloud fleet management platform, dashboard, and associated APIs accessible at herbairpro.com.

"User", "you" refers to any individual or entity accessing the Service or operating a Device.

2. Acceptance of Terms

By accessing the Service or operating a Device, you agree to be bound by these Terms & Conditions. If you do not agree, you must discontinue use immediately.

3. Intended Use

The HerbAir Pro system is designed exclusively for the thermal diffusion and volatilization of legal botanical materials, including dried herbs, flowers, and plant-derived concentrates. You are solely responsible for ensuring that your use of the Device complies with all applicable local, regional, and national laws and regulations.

The Device must not be used with any materials not intended for volatilization, nor modified in a way that bypasses or disables safety systems.

4. Device Safety

The HerbAir Pro includes multiple safety mechanisms: thermal fuse protection, tilt detection, over-temperature shutdown (235°C hard limit), and watchdog timers. Do not tamper with, disable, or bypass any safety feature. Doing so voids all warranties and may create hazardous conditions.

Always operate the Device on a stable, heat-resistant surface. Never leave the Device unattended while heating. Allow full cooldown (below 50°C) before handling internal components.

5. Cloud Services & Fleet Management

The Service provides remote telemetry monitoring, configuration management, and fleet analytics. Cloud features require an active internet connection and are provided on an "as-is" basis.

We reserve the right to modify, suspend, or discontinue the Service at any time with reasonable notice. Telemetry data is retained as described in our Privacy Policy.

6. Intellectual Property

HerbAir Pro, its firmware, hardware designs, cloud infrastructure, and associated documentation are protected by intellectual property rights. The thermal diffusion system is patent pending (ZA 2026/02286).

You may not reverse-engineer, decompile, or create derivative works from the firmware or cloud service without prior written consent.

7. Warranty & Liability

HerbAir Pro hardware is warranted against manufacturing defects for 12 months from the date of purchase. This warranty does not cover damage from misuse, modification, or operation outside specified parameters (150–230°C operating range).

To the maximum extent permitted by law, HerbAir Pro (Pty) Ltd shall not be liable for any indirect, incidental, or consequential damages arising from the use or inability to use the Device or Service.

8. Account & API Access

You are responsible for maintaining the confidentiality of your API tokens and device credentials. Notify us immediately if you suspect unauthorized access to your account or devices.

9. Modifications

We may update these Terms at any time. Continued use of the Device or Service after changes constitutes acceptance. Material changes will be communicated via the Service dashboard or email.

10. Governing Law

These Terms are governed by the laws of the Republic of South Africa. Any disputes shall be subject to the exclusive jurisdiction of the courts of South Africa.
